Standard Terms and Conditions of Sale

Introduction :

These provisions shall govern the relations between the Contracting Parties; hereinafter referred to as the "Client" and the association Demain en main called the "Asso".

I - THE ORDER

a) "The Client" may sign up for an immersion stay on the proposed dates, by email to the email address asso.demainenmain[AT]outlook.fr, or by post to the address of the head office Demain En Main, 106 rue du Périgord, 24360 Varaignes, France.
b) Upon receipt of the order, the "Asso" will issue a membership form unless it is forced to refuse it if it was not able to honor it by return and in the same form as the order within 8 days (eight) thereof.
c) The order must be confirmed 8 (eight) days following the acceptance of it by the payment of a deposit of 50% of the cost of the requested service.

II - WITHDRAWAL OF THE ORDER

a) "The Customer" has the right to withdraw, in accordance with the Consumer Code L.221.28 without reason, and subject to expressing his choice according to the form chosen for the order (I, a) within 15 days (15) from the confirmation made to him (I, b).

b) The deposit that was paid will then be fully returned within 8 days (eight).

III - CANCELLATION

Regardless of the exercise of the right of withdrawal, the cancellation of the stay will give rise to the attribution of a penalty for the benefit of the "Asso" intended to compensate for the costs incurred, as follows:

a) Cancellation one month before the beginning of the stay will result in a penalty of 25% (twenty-five percent) of the sums paid; the "Asso" returning within 8 days (eight) of the cancellation the surplus paid.

b) Cancellation 15 days (fifteen) before the beginning of the stay will result in a penalty of 50% (fifty percent) of the sums paid; the "Asso" returning within 8 days (eight) the surplus paid.

c) Cancellation outside the deadlines mentioned above (a and b) before the beginning of the stay; all sums paid will be definitively acquired by the "Asso" as a penalty.

IV - FORCE MAJEURE

a) The death of the "Customer" automatically entails the cancellation of the order, unless substitution was previously accepted by the "Asso".
Failing this, the sums paid will be returned to his estate, which must be established.

(b) The death of a close relative (father, mother, spouse, child to the exclusion of any other person) will give rise to the full reimbursement of the sums paid, on presentation of a death certificate and proof of the family relationship.

c) The cancellation of the air flight of the airline chosen for the transport of the "Customer" from his place of residence will give rise to the full refund of the sums paid, on presentation of his ticket and the cancellation of the flight selected.

V - COMPLAINT

a) The services offered by the "Asso" may be modified due to weather conditions or the defection of a service provider which the "Asso" has used.

The "Asso" will use its best efforts to offer the "Client" equivalent services.

b) Any complaint by the "Customer" must be notified to the "Asso" either at its computer address asso.demainenmain[AT]outlook.fr, or at its registered office Demain En Main, 106 rue du Périgord, 24360 Varaignes, France within 15 (fifteen) days from the event that occasion it.

The "Asso" undertakes to provide its explanations within a fortnight.

The parties involved respectively undertake to deploy their best to the most appropriate solution to their dispute.

c) The "Customer" acknowledges that the amicable settlement must imperatively precede any legal action during which their exchanges will take place.

d) The "Client" is informed that any possible legal action can only be brought before the courts dependent on the seat of the "Asso", which is none other than that of the formation of the contract and its execution.
